TERMS & CONDITIONS
ALLOTMENT
Prospective buyer shall have the priority in all respect in discussion before settlement of the price. On successful negotiation with prospective buyer, the Company will issue an allotment letter subject to receipt of earnest money which is 2% of the agreed price and a specimen of agreement copy with specific terms and conditions to the Applicant(s).
The buyer (s) shall then start making payments as per the payment schedule.
PAYMENT
All the down payment, installments and other charges are to be made on the due dates. ZEFYR Real Estate Ltd / H&Z Construction may issue reminders to the buyer (s) to strictly adhere to the schedule of payment, to ensure timely completion of Construction.
CANCELLATION OF ALLOTMENT
Delay in payment beyond the due date will make the allottee(s) liable to pay a delay charge as per deed of agreement.
Developer can cancel the allotment of the said apartment of the purchaser by providing 60 (sixty) days’ notice by registered post for his/her failure of payment of installment money of the apartment.
If the payments are delayed beyond 90 days, ZEFYR Real Estate Ltd / H&Z Construction shall have the right to cancel the allotment. In such case the amount paid by the buyer(s) will be refunded after deducting BDT 4,00,000.00 and the refund will be given after resale of apartment.
REGISTRATION
The buyer will bear all cost relating to transfer, registration, gain tax etc.
COMPANY’S RIGHT
Limited changes in the specification, design or layout of the apartment and other facilities may be made by ZEFYR Real Estate Ltd / H&Z Construction in larger overall interest or due to unavoidable reason(s). After taking over the apartment, the buyer must consult with the company prior to undertaking any structural or layout changes within the apartment complex. Failure to do so will be at the sole risk of the buyer.
HOME OWNERS’ ASSOCIATION
The house-owners, after full payment of all dues will form an Association for managing the affairs of common interest of the Apartment Complex and elect from themselves office bearers for the Association. Each flat-owner must deposit BDT 50,000.00 for each apartment for creating a reserve fund for common service expenses of the complex.
HAND OVER
The possession of each apartment and parking space shall be handed over to the buyer on completion of construction and on full payment of all installments and other charge and dues. Prior to this, the possession of apartment will rest with the company.
ALLOTMENT TRANSFER
Until full payment of installment and other charges, the buyer shall not have the right to transfer the allotment to a third party.
